Terms of Service
By accessing or using the Poga platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Poga provides a rental marketplace platform that connects landlords, property managers, and tenants. Our services include property listings, tenant screening, lease management, rent collection, and related tools.
You must be at least 18 years old and legally capable of entering into binding agreements to use our platform. By creating an account, you represent and warrant that you meet these requirements.
User Agreements
When you create an account on Poga, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Landlords and property managers agree to provide truthful property information, maintain properties in habitable condition, and comply with all applicable housing laws and regulations.
Tenants agree to use the platform in good faith, provide accurate application information, and honor the terms of any lease agreements entered into through the platform.
Limitation of Liability
Poga acts as a platform connecting landlords and tenants. While we take steps to verify users through our KYC process, we are not a party to rental agreements between landlords and tenants unless explicitly stated otherwise in a Facilitated Rental arrangement.
For Facilitated Rentals, Poga assumes responsibility for mediating the rental process and takes liability for the accuracy of our KYC verification. For Direct Rentals, disputes are between the landlord and tenant, though we provide the contractual framework.
Poga is not liable for any indirect, incidental, special, or consequential damages arising from the use of our platform, except where required by applicable law.
Intellectual Property
All content, features, and functionality of the Poga platform — including text, graphics, logos, icons, and software — are the exclusive property of Poga and are protected by copyright, trademark, and other intellectual property laws.
Users retain ownership of content they upload to the platform, such as property photos and descriptions. By uploading content, you grant Poga a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the platform's services.
You may not copy, modify, distribute, or create derivative works from any part of the Poga platform without prior written consent.
Account Termination
You may close your account at any time by contacting our support team. Upon closure, your personal data will be handled in accordance with our Privacy Notice.
Poga reserves the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a risk to other users. We will provide notice before termination where practicable.
Termination does not release you from obligations under any active lease agreements entered into through the platform.
Dispute Resolution
For disputes between landlords and tenants in Facilitated Rentals, Poga will mediate and work toward a fair resolution based on the terms of the lease agreement.
For disputes in Direct Rentals, Poga encourages parties to resolve matters directly. We may provide documentation and communication records from the platform to support resolution.
Any disputes with Poga itself should first be addressed through our support team. If a resolution cannot be reached, disputes will be handled through binding arbitration in accordance with applicable law.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the jurisdiction in which Poga operates, without regard to conflict of law principles.
Poga complies with local housing laws and regulations in each jurisdiction where our services are available. Users are responsible for understanding and complying with laws applicable to their specific situation.
We reserve the right to update these terms at any time. Material changes will be communicated via email or platform notification at least 30 days before they take effect.
